The Government has introduced the new regulations to control electrical work carried out to houses and flats. Dwellings associated with a business are also included, for example shops and public houses with a flat over. The legislation does not extend to any other types of building at the moment. The regulations have been introduced to reduce the number of deaths and injuries, which occur in dwellings due to electrical faults, and to control the 'Cowboy builders'.

Part P also applies to electrical installations in or on land associated with dwellings, for example fixed lighting and pond pumps in gardens. It also applies to electrical installations in outbuildings such as garages, sheds and greenhouses. Part P will apply to new electrical work in dwellings or extensions to dwellings unless:

You are only adding lighting points to an existing circuit or

You are only adding socket outlets and fused spurs to an existing ring or radial circuit or

You are only installing or upgrading main or supplementary equipotential bonding and Any electrical work in a kitchen or other special location such as a bathroom, swimming pool or sauna will be controlled. (Ask Building Control for full details of special locations).

The Good News

If you employ an electrical contractor or electrician who is a registered installer under a 'Competent Person Scheme' then you will not need to apply to The Local Authority for Building Regulations Approval. The electrician will design, install and certify that their work is in accordance with the new regulations. They will also issue a certificate to the Local Authority to show they have complied. The Local Authority will store this information in its database, and will be able to respond to any enquiry in connection with a later sale of the property.

The Bad News

If you do not use a registered installer you will need to apply to the Local Authority for Building Regulations approval, and will be charged an application fee. The Full Plans and Building Notice procedure can be used.

For Electrical work in isolation, such as re-wiring or work in a kitchen or bathroom, then the Building Notice procedure may be the quickest and easiest. The fee payable will be £165.00 + VAT, in order to cover the Local Authorities costs. It is more likely that a full plan application will be deposited where the work is not solely electrical, for example an extension to a dwelling. Such work will not be notifiable under a Competent Persons |Scheme and will form part of your building regulations submission. In this instance the fee will be in line with the current charges.

In order for the Local Authority Building Control Department to be able to approve the plans, then a note of the drawings regarding the electrical installation will be required. We suggest the following wording would be acceptable;

'All Electrical work required to meet the requirements of Part P (Electrical Safety) must be designed, installed, inspected and tested by a person competent to do so. Prior to completion the Council must be satisfied that an appropriate electrical installation certificate has been issued for the work, and it has been signed by a person competent to do so.'

The Local Authority will need to inspect the electrical installation at first fix stage, and will require the installation to be tested upon completion by others, and evidence of the test provided before a Building Regulations Completion Certificate can be issued.
